Liability and provisions for packaging

With regard to the EU Packaging Regulation (PPWR), the German Foundation Central Agency Packaging Register (ZSVR) is issuing an urgent warning about considerable legal uncertainty – with potentially far-reaching consequences for sellers, producers and the entire waste disposal system. The trigger is, in particular, the new, Europe-wide uniform definition of “producer”, which will take effect on 12 August 2026 and fundamentally alters the previous understanding of German packaging law.

Check producer registration correctly

When selling electrical appliances, rechargeable batteries and batteries in Germany, there are legal producer registration requirements that finance the disposal of old appliances and batteries. The German Central Organisation for Private Copying Rights (ZPÜ) asserts remuneration claims for devices and blank media against producers and importers on behalf of nine German collecting societies. The ZPÜ recently wrote to numerous IT companies and is now also demanding information and a device levy for game consoles.
